Taylor Barr, Government Affairs Director at the Digital Chamber, has highlighted the potential consequences of failing to pass the Digital Asset Market CLARITY Act. He argued that rejecting the legislation would prevent the implementation of several new regulatory tools aimed at consumer protection and combating illicit finance.

In an X post on Monday, Barr said opposing the CLARITY Act would also mean rejecting expanded capabilities for regulators. The bill, currently under negotiation, includes provisions designed to strengthen oversight in the digital asset space.

The key elements outlined in the post include $150 million in authorized funding for FinCEN over five years to bolster anti-money laundering efforts. The legislation would also grant new Treasury Department authority to restrict transactions linked to money-laundering concerns. Additionally, it proposes establishing a permanent CFTC Digital Commodity Retail Advocate to represent retail investor interests.

What’s inside the CLARITY Act

Other measures in the current draft include a public-private information-sharing pilot program, enhanced consumer education initiatives focused on identifying and reporting fraud, and requirements for customer-asset segregation, disclosure, and market integrity standards for digital asset intermediaries.

The bill also expands AML/CFT (Anti-Money Laundering and Countering the Financing of Terrorism) requirements by incorporating suspicious activity monitoring and formal risk-management standards. It further introduces a targeted mechanism to temporarily pause specifically identified suspicious transactions.

Barr emphasized that these represent only a snapshot of the provisions under discussion, as the Senate package continues to be finalized. The CLARITY Act aims to address gaps exposed in previous crypto market events by providing clearer regulatory frameworks while attempting to balance innovation with accountability.

Why supporters back the legislation

Supporters of the legislation argue that these measures would give regulators more effective means to protect consumers and disrupt illicit activities without overly restricting legitimate market participation.

Among them is U.S. Senator Cynthia Lummis, who has advocated for the CLARITY Act as a way to safeguard cryptocurrency owners from the pitfalls exposed by major platform collapses like Celsius and Voyager. In a post on X on Monday, Lummis stressed the legislation’s importance: it would ensure digital asset holders retain ownership of their crypto even if the platforms holding the assets file for bankruptcy.

“When Celsius and Voyager went bankrupt, customer deposits didn’t stay customer deposits,” she wrote. “They became assets in a bankruptcy pool, fought over by creditors who had never even heard of the customers who owned them.”

The debate isn’t over yet

As debates continue, the CLARITY Act remains central to efforts to establish comprehensive rules for the sector. Whether the included provisions survive final negotiations and secure sufficient congressional support remains to be seen. 

The debate reflects broader policy questions around balancing stronger oversight and consumer protection with preserving the decentralized nature of blockchain technology. Industry participants, policymakers, and advocacy groups continue to engage with lawmakers as negotiations move forward.
