The Chief Justice of India (CJI), Sanjiv Khanna, has recommended Justice B. R. Gavai as his successor. Justice Gavai was part of the two-member bench with Justice Augustine Masih, who had previously dismissed the writ petition by 54 WazirX users against the exchange management and its co-founder, Nischal Shetty, citing a lack of crypto regulations in India.
Hearing the petition by distressed Wazirx users, Justice Gavai had remarked, “We are not inclined to entertain the plea and representation may be made to the authorities and let it be decided in accordance with law.”
Justice Gavai will replace the present CJI in May and will continue as the CJI for 6 months until his retirement in November of this year. He is presently the second-most senior judge in the Supreme Court. Apart from the infamous WazirX petition, he has been a part of many constitutional benches that have given landmark deliveries.
He was part of the 5-member bench that upheld the central government’s decision to abrogate Article 370 in Jammu and Kashmir. He was also part of the bench that approved the government’s demonetization of 500 and 1000 rupee notes. Another famous verdict given by Justice Gavai states the guidelines for demolitions and says no property should be demolished without a prior notice of 15 days.
Justice B.R. Gavai was born on 14th November, 1960, at Amravati. He will be the second CJI from the scheduled caste community, the first one being CJI KG Balakrishnan. He was previously the Advocate General and Bombay High Court Judge and will be the 52nd Chief Justice of India.
