Uniswap Case Judge Calls Ethereum A Commodity In Dismissal Order

The United States District Court judge, Katherine Polk Failla, has referred to Ethereum as a commodity in her dismissal of a class-action lawsuit against the decentralized exchange Uniswap.

Uniswap users claimed that due to scam tokens on the exchange, they lost their money. On August 30, a dismissal order came from Judge Katherine Polk Failla, where she wrote that ETH and Bitcoin are “crypto commodities.”

The judge was not convinced by argument that Uniswap’s token sales could be covered under the Exchange Act. Faila has much experience overseeing cases related to cryptocurrency. In the past, she oversaw the crypto cases where Tether and Bitfinex were included, and she is also the judge overseeing the SEC lawsuit against Coinbase.
