In the ongoing federal trial of Roman Storm, Co-founder of Tornado Cash, the judge granted permission for testimony regarding potential modifications to a cryptocurrency mixing service code.
The US District Judge Katherine Polk Failla said that expert testimony emphasizing Storm could have made changes to stop criminals from using the platform, is now allowed in the court.
Judge Failla’s Sunday order said, “Such testimony is permissible. The defense says that ‘there will be no evidence that a “user registry smart contract” has ever actually been used in the blockchain industry.’ That may be so, but Mr Werlau can still testify about implementing such a feature so long as it is technologically feasible and a software developer like Mr Storm would likely have known about it.”
On Monday, the sixth consecutive day of the trial, the prosecution said that it wants to make its case against Storm clearer. Storm is being charged with money laundering, conspiracy to run an unlicensed money transmitter, and conspiracy to break U.S. sanctions.
In 2024, Alexey Pertsev, the other Co-founder of Tornado Cash, was found guilty of money laundering and sentenced to five years in prison by a Dutch court.
